These Terms of Service ("Terms") govern your use of Plunge, a thermal wellness and recovery tracking application published by Nereus Data ("we," "us," or "our") for Apple Watch and iPhone (the "App").

By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. Description of Service

Plunge is a wellness tracking application that records thermal recovery sessions (sauna, cold plunge, steam room, infrared, hot tub, cold shower, and red light therapy) and integrates with Apple HealthKit for health metric tracking. The App provides breathwork coaching, session analytics, and gamification features.

Plunge is a wellness tracking tool, not a medical device. It does not provide medical advice, diagnosis, or treatment. Always consult a qualified healthcare provider before beginning any thermal wellness practice, especially if you have cardiovascular conditions or other health concerns.

2. Eligibility

You must be at least 13 years of age to use the App. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

3. License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App on Apple devices that you own or control, subject to these Terms and the Apple Media Services Terms and Conditions.

4. Subscriptions and Purchases

Pricing

Some features may require a paid subscription. Subscription options include monthly and annual plans. Pricing is displayed within the App and on the App Store, and is subject to change with notice.

Billing

All subscriptions are billed through the Apple App Store. Payment is charged to your Apple ID account at confirmation of purchase.

Renewal

Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the current period.

Cancellation

You may cancel your subscription at any time through your Apple ID account settings. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial billing periods.

Refund requests must be directed to Apple, as all purchases are processed through the App Store. Visit reportaproblem.apple.com.

5. Apple's Standard EULA

Use of the App is also governed by Apple's Standard Licensed Application End User License Agreement ("Standard EULA"), available at Apple's Standard EULA. In the event of a conflict between these Terms and the Standard EULA, these Terms shall control to the extent permitted by applicable law.

The App is designed for wellness tracking and does not constitute medical advice, diagnosis, or treatment. Thermal exposure (heat and cold) carries health risks including but not limited to dehydration, heat stroke, hypothermia, and cardiovascular events. You are solely responsible for your safety during thermal wellness activities.

The App provides JSON export functionality for your session data. You may export your data at any time for personal use or to transfer to another service.

The App, including its design, code, branding, and user interface, is owned by Nereus Data and protected by intellectual property laws.

Your privacy is important to us. Please review our Privacy Policy for details on how we handle information. In summary: the App operates locally on your device, and we do not collect or store personal data on our servers.

12. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the App will be uninterrupted, error-free, or free of harmful components. We do not warrant the accuracy of any health metrics, thermal dose calculations, or recovery estimates.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEREUS DATA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP, INCLUDING BUT NOT LIMITED TO PERSONAL INJURY, HEALTH COMPLICATIONS, LOSS OF DATA, OR INTERRUPTION OF SERVICE.

Our total liability for any claim related to the App shall not exceed the amount you paid for the App in the 12 months preceding the claim.

14. Indemnification

You agree to indemnify and hold harmless Nereus Data from any claims, damages, or expenses arising from your use of the App or violation of these Terms.

15. Termination

We may terminate or suspend your access to the App at any time for violation of these Terms. Upon termination, your license to use the App is revoked.

16. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by updating the "Last Updated" date. Continued use of the App after changes constitutes acceptance of the updated Terms.

17. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.
